Terms and Conditions

The present General Conditions of Use (hereinafter “CGU”) are intended to define terms and conditions under which PATISSERIE E.LADUREE shall make available to users (hereinafter “Users”) of the website http://laduree.fr, (hereinafter “the Site”) services associated therewith, and under which Users shall access the Site and use said services.

Any log-on to the Site shall be subject to compliance with the GCU.

The User hereby acknowledges, accordingly, that access to the Site itself shall imply acceptance of all the conditions described hereinafter.

Access to the Website

The User of the Site hereby confirms the execution of a check to the effect that the IT configuration which they employ contains no viruses, and is in perfect working order.

It should be noted that the confidentiality of traffic on the Internet cannot be guaranteed, and that it is the responsibility of each Internet User to implement appropriate measures for the protection of their own data and/or softwares against contamination by any viruses circulating on the Internet.

PATISSERIE E.LADUREE shall not be liable for any damages, whether direct or indirect, resulting from access, use or downloading of content from the Site, specifically any damage or viruses which might infect the computer of the User or any other hardware.

PATISSERIE E.LADUREE shall endeavour to permit access to the Site 24 hours a day, 7 days a week 7, except in the event of force majeure or circumstances beyond its control, subject to any outages and maintenance operations which are necessary to the correct operation of the Site and of services.

Consequently, PATISSERIE E.LADUREE cannot guarantee the availability of the Site and/or of services, the reliability of transmissions and performance capabilities with respect to response times or quality. No technical assistance vis-à-vis the User is provided, whether electronically or by telephone.

The liability of PATISSERIE E.LADUREE shall not be enforceable in the event of impossibility of access to the Site and/or of the use of services.

Moreover, PATISSERIE E.LADUREE may have occasion to suspend the Site, or any part of its services, at any time and without prior notice, with no resulting entitlement to compensation. The User hereby acknowledges and accepts that PATISSERIE E.LADUREE shall not be liable for any interruptions, or for any resulting consequences for the User or any third party.

Information and/or documents posted on the Site, and/or which are accessible via the Site, originate from sources which are considered to be reliable.

However, said information and/or documents may contain technical inaccuracies and typographical errors.

PATISSERIE E.LADUREE shall reserve the right to correct these errors, immediately they are brought to its attention.

Information and/or documents made available on the Site are subject to modification at any time, and may have been subject to updating. In particular, they may have been subject to updating between the time of downloading and the time of consultation thereof by the User.

The use of information and/or documents which are available on the Site shall be subject to the full and exclusive responsibility of the User, who shall assume any resulting consequences in their entirety, wherein any enforcement of the liability of PATISSERIE E.LADUREE shall not be pursued.

PATISSERIE E.LADUREE shall not, under any circumstances, be held liable for any damages, of any kind whatsoever, resulting from the interpretation of information and/or documents which are available on the Site.

Intellectual property

The Site shall be the exclusive property of PATISSERIE E.LADUREE.

The general structure of the Site and its content shall be the exclusive property of PATISSERIE E.LADUREE, and are subject to legal protection with respect to intellectual property (copyright, databases, softwares, trademarks, etc.).

Any reproduction, representation or adaptation of the Site, whether in whole or in part, by a natural or legal person, by any method whatsoever, without the express authorization of PATISSERIE E.LADUREE shall be prohibited, and shall constitute an act of piracy which is specifically sanctioned by Articles L. 335-2 and following of the Intellectual Property Code.

Any reuse of extraction, whether in whole or in part, of databases from the Site by a natural or legal person, by any method whatsoever, shall be prohibited, and shall constitute an act of piracy which is sanctioned by Articles L. 343-1 and following of the Intellectual Property Code.

Any total or partial reproduction of the trademarks and logos of PATISSERIE E.LADUREE, without the express authorization of the latter, shall be prohibited under the terms of Articles L. 713-2 and following of the Intellectual Property Code.

Protection of personal data

In accordance with the amended Law on Data Processing & Civil Liberties n°78-17 of 6th January 1978, and the General Data Protection Regulation (hereinafter “GDPR”) n° 2016/679/EU of 27th April 2016, PATISSERIE E.LADUREE, in its capacity as processing officer, hereby undertakes to observe the privacy of Users of the Site.
