ARTICLE 1: ORGANIZING COMPANIES
PÂTISSERIE E. LADUREE, a société par actions simplifiée (simplified joint stock company) with capital of 372,204 euros, headquartered at 84 avenue d'Iéna - 75116 Paris, registered in the PARIS Trade and Companies Register under number 572 045 540, represented by Lov & Sweet, itself represented by Mr David HOLDER,
(hereinafter referred to as "LADUREE" or the "Organizing Company")
AND
GEMMYO SAS, a simplified joint-stock company with share capital of 775,937.50 euros, headquartered at 26 rue Berthollet - 75005 Paris, registered with the Paris Trade and Companies Registry under number 533 715 314, represented by Charif DEBS, duly authorized for this purpose,
(hereinafter referred to as "GEMMYO" or the "Organizing Company")
Hereinafter together referred to as the "Organizing Companies",
Organize from May 14 to May 21, 2024 inclusive, a no-obligation contest entitled "Precious Moments Contest" (hereinafter referred to as the "Contest").
ARTICLE 2: ANNOUNCEMENT OF THE GAME
The Game is announced via the LADUREE Newsletter and the GEMMYO Newsletter, each Organizing Company having its own conditions and prizes.
ARTICLE 3: CONDITIONS OF PARTICIPATION
The Game is open to all natural persons over the age of majority on the date the Game begins, residing in metropolitan France (including Corsica) and registered with the Ladurée loyalty program (hereinafter "Le Club Ladurée") or the Gemmyo Newsletter, with the exception of employees and representatives of the Organizing Companies or related to their corporate groups, their partners, and their subcontractors, as well as their advisors and family members, including cohabitants and, in general, any company or individual participating, directly or indirectly in the establishment or implementation of the Game.
The Organizing Companies draw attention to the fact that any minor participating in the Game is deemed to be participating under the control and with the consent of his or her parents or the holder(s) of parental authority, or failing that, his or her legal guardian(s).
Participation in the Game implies full and unreserved acceptance of these rules. Any entry that is incomplete, inaccurate, falsified, contains false information, does not comply with the rules or is received after the specified date and time of the Game will be considered null and void and will result in the participant's elimination. Similarly, any participation involving the use of a bot (multiple computer entries made automatically and repeatedly from the same IP address) will be considered null and void and will result in the elimination of the participant(s).
Failure to comply with these conditions will result in the winner's ineligibility.
Any fraud or failure to comply with the present rules may result in the exclusion of the participant concerned from the Game, and the Organizing Companies reserve the right to take legal action against the participant concerned. Any dispute or claim relating to this Game must be made in writing and sent to one of the Game addresses and will not be taken into consideration after a period of one month from the end of the Game.
ARTICLE 4: HOW TO ENTER THE GAME
The principle and organization of this game are as follows:
To participate, from May 14, 2024 to May 21, 2024 at 11:59 pm:
- Ladurée participants must subscribe to the GEMMYO newsletter and provide their first name, last name and email address to be eligible to win;
- the Gemmyo participant will have to join the Ladurée Newsletter by indicating certain personal information to try to be drawn.
ARTICLE 5: PRIZES UP FOR GRABS
The prizes up for grabs are as follows (hereinafter referred to as the "Prize(s)"):
LADUREE prize: One (1) Ladurée x Gemmyo coupon worth one thousand five hundred (1500) euros (incl. VAT) to be spent in Gemmyo boutiques or online at https://www.gemmyo.com/ up to and including May 21, 2025.
GEMMYO prize: One (1) "GRAND BRUNCH 75 CHAMPS-ÉLYSÉES" for two people at Ladurée Champs Elysées, with a maximum total value of two hundred and forty (240) euros (including tax) (for two adults) on the desired date, subject to availability when booking with the establishment. Reservations must be made within one year of being notified of the prize.
This Prize will not be exchangeable and will not give rise to any partial or total reimbursement in any form whatsoever.
The winners concerned will be designated after verification of the validity of their participation with regard to the criteria detailed in these rules for LADUREE and GEMMYO respectively.
The Participant acknowledges that the photographs illustrating the Contest are not contractual.

ARTICLE 6: PRIZE ALLOCATION
6.1 Winner draw
A draw will be organized on May 21, 2024 by LADUREE and GEMMYO respectively and will designate one (1) Ladurée winner and one (1) Gemmyo winner. It will be carried out by an employee of each Organizing Company (or any company designated by the Organizing Companies) in the presence of 2 witnesses.
6.2 Informing the winner and receiving the Prize
The winners designated in the draw will be contacted either by LADUREE or by GEMMYO by email in order to announce their win and to specify once again the terms and conditions of benefiting from their Prizes.
If, within seven (7) days following the e-mail, a winner drawn at random has not replied to the Organizing Body concerned, he/she will be deemed to have forfeited the Prize and another draw will take place under the conditions stipulated in article 6.1.
In the absence of a positive return from two persons drawn per Lot within the time limit set, the Lot may be cancelled by the Organizing Body concerned.
ARTICLE 7: LIABILITY
The liability of the Organizing Companies is strictly limited to the delivery of the Lots to the winners.
Participation in the Game implies knowledge and acceptance of the characteristics and limits of the Internet, in particular with regard to technical performance, response times for consulting, querying or transferring information, the risks of interruption, and more generally, the risks inherent in any connection and transmission on the Internet, the lack of protection of certain data against possible misappropriation and the risks of contamination by any viruses circulating on the network. Consequently, the Organizing Companies may not under any circumstances be held responsible for, and this list is not exhaustive:
1. the transmission and/or reception of any data and/or information on the Internet ;
2. any malfunction of the Internet network preventing the proper running/functioning of the Game;
3. failure of any receiving equipment or communication lines ;
4. loss of any paper or electronic mail and, more generally, loss of any data;
5. routing problems ;
6. the operation of any software ;
7. the consequences of any virus, computer bug, anomaly or technical failure;
8. any damage caused to a Participant's computer;
9. any technical, hardware or software failure of any kind that prevents or limits participation in the Game or damages a Participant's system;
10. the malfunctioning of the Lot distributed as part of the game, and any direct and/or indirect damage they may cause.
Lastly, the Organizing Companies reserve the right, for any reason whatsoever, to cancel, postpone, interrupt or extend the Game or to modify all or part of the terms and conditions of the present rules, in compliance with the latter. If, as a result of an event beyond their control, they are forced to apply this right, they shall not be held liable.
The Organizing Companies reserve the right to definitively exclude any person whose fraudulent behavior interferes with the proper running of the Game.
ARTICLE 8: PERSONAL DATA
Participants are reminded that to take part in the Game, they must provide certain personal information (name, address, telephone number, e-mail address, etc.). This information is recorded and saved in a computer file and is necessary to take into account their participation, to determine the winners and to award and send the Prizes. This information is intended for the use of the Organizing Companies, and may be transmitted to their technical service providers and to a service provider responsible for sending the Prizes, where applicable. The data collected in this way may be used within the legal framework.
Pursuant to Law No. 78-17 of January 6, 1978 relating to information technology, files and freedoms, and the General Regulation on the Protection of Personal Data (hereinafter "RGPD") No. 2016/679/EU of April 27, 2016, participants have the rights to access, rectify and delete data concerning them.

ARTICLE 9: COPY OF THE REGULATIONS
The present rules will be available on the digital catalog of the Organizing Body.
ARTICLE 10: APPLICABLE LAW
These rules are subject to French law, and any dispute will be subject to the jurisdiction of the French courts of the place of residence of the defendant.
6.1 Winner draw
A draw will be organized on May 21, 2024 by LADUREE and GEMMYO respectively and will designate one (1) Ladurée winner and one (1) Gemmyo winner. It will be carried out by an employee of each Organizing Company (or any company designated by the Organizing Companies) in the presence of 2 witnesses.
